Under the Data Privacy Act 2012, PH365 is committed to guarding and protecting your privacy and any information pertaining to your personal data. This Privacy Policy has been designed to provide details and the processes we use for your data collection and use, including your rights in accordance with our guidelines.

We understand that policies change, and we are serious about modifying and adjusting our policies to ensure we apply the best practices in privacy security and data protection not just locally but also in compliance with international jurisdictions. While we do our best, there is no certainty of absolute protection of your sensitive information when shared on the internet.

PH365 Scope and Commitment

Our Privacy Policy shall apply to all information entered upon the use of our services. By registering or logging in, and accepting our Terms of Service, you grant us the right to collect, use, disclose, retain, and protect your information in lieu of these terms.

If you do not consent to the use of your data, the Company is under no obligation to inform or provide you access to requested products and services.

As a Company licensed by the Malta Gaming Authority and certified by eCogra, our platform is not intended for use by:

  • Persons under 21 years of age;
  • Individuals serving under the Philippine government, staff of PH365, state forces, or military personnel.

Your Rights and Choices

  • Your right to be informed as soon as possible that your data is currently being processed or has been processed;
  • By agreeing to the Agreement, the Company grants you access to change your personal information and the right to modify or update any inaccurate personal data;
  • You have the choice to refuse PH365’s request to process your information;
  • Demand access to your processed data, including but not limited to:
    • Details of the players information gathered through verification.
    • Registered names and addresses you submitted
    • Information about PH365’s manner of acquiring your data
    • Details on any automated processes that use your data as the sole basis for decisions significantly impacting you
    • Dates indicating the last time your personal information was accessed or modified
    • The name, identity, and address of the personal information controller responsible for managing your data  
  • Your right to request the erasure of your data on our database upon discovery and with substantial evidence that the data processed were incomplete, outdated, false, gathered without approval, or have been used unlawfully and;
  • Submit a formal complaint with the federal agency National Privacy Commission (NPC).

How We Collect Your Data

PH365 employs a systematic approach to gather personal information, utilizing various methodologies to ensure comprehensive data acquisition. This includes:

  • Collection of data via registration forms, account setup processes, and direct communications.
  • Use of cookies, server logs, and other web technologies to capture technical and usage data.
  • Integration of data from external entities such as payment processors and service providers.

Where We Use Your Data

Upon agreeing to PH365 Terms and Conditions and registering on our site, you acknowledge that we shall use your information on:

  • Account creation, management, and provide support;
  • Process all your transactions;
  • Data gathering processes to analyze service usage to improve user experience according to the results;
  • Collect feedback to improve the Company’s offerings;
  • Customer support assistance to help address and resolve any inquiries or concerns and;
  • Send optional promotional materials and offerings to your registered phone number or email address.

To Who We Share Your Information

Under the Data Privacy Act, PH365 is obliged to share your personal information on the following entities:

  • Company providers for the purpose of payment processing, customer support, IT services, authentication, and data storage;
  • Regulatory bodies for the Company’s legal obligations and requirements and;
  • Third parties responsible for providing you and the Company security against fraud, anti-money laundering, and other illegal activities.

Why Your Data is Being Kept

Your data is stored for you to continue accessing PH365’s services. Additionally, keeping your information is also in accordance with the Anti-Money Laundering Act of 2002. Upon request by the Anti-Money Laundering Council (AMLC), your data shall be shared to safeguard the integrity of the Philippines and protect the country from being used as a money-laundering site to fund unlawful activities.

The information we gathered shall also be kept to establish or defend any legal claims and to comply with our contractual obligations.

We assure you that any data shared shall be saved in a secure manner, and will only be used for the purposes as stated on this Policy.

You have the privilege to cease using PH365’s services. However, your data shall be kept for five years, and after such shall be purged immediately.

Policy Changes, Amendments, Revisions

This Privacy Policy may undergo amendments and revisions periodically. These changes will be in accordance with our practices or legal requirements. A revision date shall be displayed on this page to inform that any new information on this Policy is in effect.

For any disputes regarding any changes, you have the right to stop using our services or decline to share personal information. 

By continuing to use our services, you imply that you accept the changes. For major revisions and amendments, we will provide notice in your email, and you may need to accept the changes to continue using the services. You can delete your PH365 account at any time.

Your Responsibilities

The use of our platform and the creation of your account is proof that you acknowledge that your information is factual, complete, and accurate. Furthermore, you are required to inform PH365 of any attempts to change your personal information.

If found to have used false information and identity, or breached the Data Privacy Act of 2012 and this Privacy Policy, the Company reserves the right to reject your application or deactivate your account, and without any notice. Any amount used or deposited shall not be returned to you. Conversely, any withdrawn amount shall be kept by you.
